Question by Marc: what can be enforced from an unsecured loan that has not been enforced and the debtor lives out of state?
Facing an unsecured loan that was taken out in the early 2000′s and was not pursued till 2011. Does the creditor have any real basis for their claims in a civil suit(asking for money despite the lack of money previously asked for). To me it sounds like the person has gone broke and now just looking for any money possible.

Debt does not disappear… UNLESS discharged by bankruptcy or otherwise settled.

Just because they previously were unable to get any money from you does NOT mean they can’t try again. There is no ‘double jeopardy’ in civil suits.
